Definitions: In these terms (a) "Goods" means products purchased by you from the Web site; (b) "Products" means products offered for sale on the Web site; (c) "Publisher" means Vertos Healthcare Pty Limited; (d) "Terms" means these terms of use and sale, the Privacy Policy, Website Terms of use and Delivery Information; and (e) "Web site" means this website, being the website of Vertos Healthcare Pty Limited.
2. Jurisdiction: By using this Web site you agree that in the event of any controversy or dispute arising with respect to your use of this site shall be settled in accordance with the prevailing rules of the judicial system of New South Wales, Australia. The application of the United Nations Convention on Contracts for the International Sale of Products adopted in Vienna, Austria, on 10 April 1980, as enacted into the law of New South Wales by the Sale of Products (Vienna Convention) Act 1986, is expressly excluded.
3. Order Acceptance: Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Ordered goods will not be shipped until your payment method is authorized, full payment and shipping and handling costs are received and the order information is verified for accuracy.
4. Prices & Currency: The prices displayed on this Web site are quoted in Australian (AUD) dollars and are valid and effective only within Australia, and such prices do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price. All prices are subject to variation without notice. . You are responsible for the payment of any shipping and handling charges and state and local sales or use taxes that may apply to your order.
5. Purchases made by users outside Australia: You agree that you will familiarise yourself with the customs policies of the country in which you reside and be responsible for compliance with all local laws which may restrict the importation of certain goods. You will be responsible for payment of any present or future tax or impost, duty or charge which may be imposed or assessed by any relevant regulatory authority on the goods purchased on the Web site.
6. Lawful use: This site may only be used for lawful purposes and in a lawful manner. When ordering from the Publisher you are the purchaser of the goods and must comply with all applicable laws and regulations. It is your responsibility to investigate and ensure that you can lawfully purchase the goods you order.
7. GST: If you are in Australia, under Australian law, you must pay an additional 10% GST (Goods and Services Tax) on both the value of the item and the value of the shipping. This is calculated in real time during the shop checkout process, and is clearly presented to you before you make payment.

9. Shipping Insurance: Shipping insurance is not included. Shipping is at your own risk.
10. No Liability for delay or part delivery: Vertos Healthcare reserves the right to make part supply of any order. Each part supply constitutes a separate contract for Sale of Goods. Failure to supply a total order will not validate any contract as regards supply of part of the order. Vertos Healthcare will not be liable to you for failure to supply a total order or for any delay in supply.
11. Transfer of Possession and Risk: Possession of the Goods passes to you upon delivery to you or your mailing address, whichever first occurs, and the Goods thereafter are at your risk. Risk in Goods passes to us if the Goods are returned to us by you or collected by us.
12. Rights Reserved: Vertos Healthcare reserves the right to refuse service, terminate accounts or cancel orders at its discretion.
13. Your Cancellation: You cannot defer or cancel an order without written authorisation from us. If we authorise the deferment or cancellation of an order, we may charge you a cancellation fee of an amount up to 25% of the value of the Goods;
14. Cancellations and your credit card: If your order is cancelled after your credit card has been charged, we will issue a credit to your credit card in the amount of the charge. Vertos Healthcare strictly follows all national regulations regarding the sale, purchase and shipment of any product or product ingredient that is considered restricted or prohibited by any law within Australia.
15. Limitations on membership: Only one individual may access Vertos Healthcare member pages at the same time using the same username and password. Vertos Healthcare may discontinue or change Vertos Healthcare services, or its availability, at any time, and you may end your subscription at any time.
16. Indemnity: By using this website, you indemnify and keep indemnified Vertos Healthcare in respect all costs, charges, interest and expenses (including legal costs as between legal and own client) incurred by us in enforcing or attempting to enforce all or any of our rights, powers or remedies arising pursuant to these Terms or otherwise arising in connection with the collection or any attempt to collect any money or in the future due or owing by you to us.
DELIVERY INFORMATION Vertos Healthcare uses Australia Post for the delivery of all orders within Australia. International orders are despatched via Airmail. Parcels will be sent in plain and unmarked packaging to assure security and privacy. Orders will be dispatched promptly once payment has been processed and prescriptions (if applicable) are received. It is our objective to have all orders dispatched within the same working day of order receipt provided we receive your order by 11am and the products are in stock. Prescriptions will be dispatched as soon as the prescription is received in the mail.
Australian Orders Australian orders will be delivered via registered post and will require a signature upon receipt. Please provide an address where someone will be available between 9am-5pm to receive and sign for the parcel, otherwise collection from your local post office will be necessary. Business addresses are preferable as the receptionist can sign for your order. We offer order tracking through Australia Post. You will be able to track your order through the Order Tracking page on our website.
International Orders International orders will be despatch via Airmail. Please allow up to 14 days for international Airmail delivery. Postage and Handling Charges
Customers can calculate their delivery cost at any time by clicking on the Postage Calculator in their shopping cart. Pensioners, Health Care and Veterans' Affairs will not be charged postage when their order is posted provided you have faxed a photocopy of both sides of your commonwealth pension entitlement card to Fax Number: (02) 9418 7304. We reserve the right to charge higher postage for extremely heavy parcels delivered within Australia. However these extra costs will never be higher than cost.
